Crowe & Co LLC, DBA Crowely (“we,” “us,” or “our”) operates the website crowely.net (the “Site”). By accessing this Site or purchasing our products, you agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.


1. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.

2. Products and Custom Orders

2.1 Custom Nature of Goods

Many of our bicycles are built-to-order (“Custom Builds”). While we make every effort to display the colors and images of our products accurately, we cannot guarantee that your computer monitor’s display of any color will be accurate. Minor variations in manufacturing and finish are inherent to the hand-built process and are not considered defects.

2.2 Modifications to the Service and Prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

2.3 Order Cancellation (Custom Builds)

Because our bikes are custom-assembled:

  • Within 24 Hours: You may cancel your order for a full refund within 24 hours of placement.

  • After 24 Hours: If assembly has begun, a cancellation fee of 15% of the purchase price will be deducted from your refund to cover labor and parts allocation.


3. Shipping and Delivery

3.1 Shipping Policy

We ship to addresses within the contiguous United States. Shipping dates provided at checkout are estimates only and are not guaranteed. Crowely is not liable for delays caused by carriers (FedEx/UPS/Freight), weather, or supply chain disruptions.

3.2 Risk of Loss

All items purchased from Crowely are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. We strongly recommend inspecting your box immediately upon arrival for damage before signing for it.


4. Returns and Refunds

4.1 Return Window

We accept returns of standard (non-custom) bicycles within 14 days of delivery. To be eligible for a return, your item must be unused, free of wear and dirt, and in the same condition that you received it. It must also be in the original packaging.

4.2 Restocking Fee

Due to the size and shipping costs of electric bicycles, all returns are subject to a 15% restocking fee. Return shipping costs are the responsibility of the customer.

4.3 Non-Returnable Items

  • Custom-painted frames or heavily modified builds.

  • Gift cards.

  • Items marked as “Final Sale.”


5. Safety and Liability (Crucial Section)

5.1 Assumption of Risk

You acknowledge that operating a bicycle (electric or standard) involves inherent risks, including the risk of serious bodily injury or death. By purchasing a Crowely bike, you voluntarily assume all risks associated with its use.

5.2 Responsibility to Follow Laws

It is your sole responsibility to know and obey all local, state, and federal laws regarding the operation of electric bicycles. This includes, but is not limited to, helmet laws, age restrictions, and speed limits.

5.3 Release of Liability

To the fullest extent permitted by law, Crowe & Co LLC shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from the use or inability to use our products. This includes accidents, collisions, or injuries resulting from rider error, poor road conditions, or failure to perform regular maintenance.


6. Warranty

Our bikes are covered by a specific Limited Warranty (detailed on our Warranty Page). This warranty covers manufacturing defects. It does not cover normal wear and tear (tires, brake pads, chains), improper assembly by the customer, water damage, or damage resulting from accidents or stunts.

Disclaimer of Warranties: Except as expressly stated in our Warranty Policy, our products are provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either express or implied.


7. No Insurance Provided

Crowely sells bicycles. We do not provide insurance. Your homeowner’s, renter’s, or auto insurance policies may not provide coverage for accidents involving the use of this bicycle. To determine if coverage is provided, you should contact your insurance company or agent.


8. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Colorado, in each case located in El Paso County (Colorado Springs).
